By accessing or using Markety AI's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
These Terms constitute a legally binding agreement between you and Digitals AI Inc. ("Markety AI," "we," "us," or "our"). The Terms apply to all users of our services, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.
Markety AI provides a unified marketing platform that includes cross-platform advertising intelligence, AI-powered chat and voice agents, and AI discovery optimization services.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance and updates may temporarily affect service availability.
We reserve the right to modify, suspend, or discontinue any part of our service at any time with reasonable notice to users.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account and for ensuring that your use of the service complies with these Terms.
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion.
You may use our services for lawful business purposes in accordance with these Terms and applicable laws.
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as explicitly stated in these Terms.
We accept major credit cards and other payment methods as specified on our platform. You authorize us to charge your selected payment method.
If payment is not received by the due date, we may suspend or terminate your access to the service until payment is made.
We may change our pricing at any time with 30 days' notice to existing subscribers. Changes will take effect at your next billing cycle.
You retain ownership of all data you provide to our platform. We do not claim ownership of your content or customer data.
We process your data solely to provide our services as described in our Privacy Policy. We implement appropriate security measures to protect your data.
We retain your data for as long as your account is active or as needed to provide services. Data is deleted in accordance with our Privacy Policy.
The Markety AI platform, including software, algorithms, and documentation, is our intellectual property and is protected by copyright, trademark, and other laws.
You grant us a limited license to use, process, and display your content solely for the purpose of providing our services.
We respect intellectual property rights and will respond to notices of alleged copyright infringement in accordance with the DMCA.
Our services are provided "as is" without warranties of any kind. We do not guarantee specific results from using our platform.
Our total liability to you for any damages arising from these Terms or your use of our services shall not exceed the amount paid by you in the 12 months preceding the claim.
You agree to indemnify and hold us harmless from any claims arising from your use of our services or violation of these Terms.
Our platform integrates with third-party services such as Google Ads, Meta, LinkedIn, and others. Your use of these integrations is subject to the terms and policies of those third-party providers.
We are not responsible for the availability, content, or practices of third-party services. Any issues with third-party services should be addressed directly with those providers.
You may terminate your account at any time through your account settings or by contacting support.
We may terminate your access immediately for violation of these Terms or with 30 days' notice for convenience.
Upon termination, your right to use the service ceases immediately. We will provide you with an opportunity to export your data for 30 days after termination.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes arising from these Terms will be resolved through binding arbitration in San Francisco, California, except for claims that can be brought in small claims court.
You agree to resolve disputes individually and waive your right to participate in class action lawsuits.
We may update these Terms from time to time. We will notify users of material changes by email and by posting the updated Terms on our website at least 30 days before they take effect.
Your continued use of our services after the updated Terms take effect constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must terminate your account.
